Some considerations:
- The federal government is responsible for promoting respect for rights and freedoms, the law and the Constitution. One of its aims is to ensure that Canada is a just and law-abiding society with an accessible, efficient and fair system of justice.
- Various groups of people and their rights may be affected differently by emergencies and responses to emergencies.
- There may be specific legal obligations to particular groups, such as Indigenous peoples.
Strategies:
- Consider risk in terms of how different people might be affected – and ensure that planned efforts mitigate those risks and do not negatively affect one group more than another.
- Consider the Charter and human rights implications of various policy and legislative proposals. Identify potentially discriminatory aspects and seek alternative measures to mitigate the legal risks.
